Recently, a client of mine had a home inspection that reported water damage to the patio/landing in front of the condo door. The patio had leaked severely enough for the garage ceiling underneath to be compromised. Who fixes this? After a few phone calls and emails to the HOA Manager, we discovered that even though this is part of the "Exterior" building that most HOAs take care of out of the dues paid by its homowners, for this association, that patio is considered to be the Homeowner's responsibility. Now there are decisions to be made about what those repairs will cost and does our client want to make those repairs.
Every time a home within a Homeowner's Association sells in the greater Phoenix area, the HOA's "Conditions, Covenants, and Restrictions" are provided to the Buyer during the escrow period. The Buyer has FIVE Days to review those documents to ascertain what their responsibilities will be when owning a home within this community. My advise is to always read those documents carefully and ask clarifying questions so that the Buyer is absolutely certain they can live within those parameters.
